FMLA administration sits where policy, timekeeping, payroll, documentation, and employee communication meet. A spreadsheet can record a balance, but it cannot reliably coordinate every handoff around a leave case.

When I review a leave workflow, I ask the team to walk one continuous case and one intermittent case from the employee's first request through the final time and payroll records. The missing handoffs usually become obvious.

The better question is not whether software can replace HR judgment. It cannot. The question is whether the system gives HR a consistent workflow and a complete record for making and documenting those decisions.

What should FMLA tracking software actually do?

At minimum, the system should organize the request, apply the employer's configured rules, keep forms and supporting documents with the case, record time used, and make the current status visible to the people responsible for the process.

The U.S. Department of Labor separates the employer's FMLA process into eligibility, rights and responsibilities, certification when requested, designation, protected leave, and return to work. Employers may use the Department's optional forms or their own compliant forms. Software can support that process, but it does not transfer the employer's legal responsibility to the vendor. How does software help with intermittent FMLA leave?

Intermittent leave is difficult because the legal entitlement is measured against the employee's actual workweek, while the operational record often arrives as individual absences, partial shifts, or schedule changes.

The Department of Labor explains that an employer may convert workweeks to an hourly equivalent for tracking, based on the employee's normally scheduled hours. When an employee uses less than a full workweek, the amount used is generally determined as a proportion of that employee's actual workweek. Should leave tracking connect to timekeeping and payroll?

For employers with recurring intermittent leave, the integration matters more than the feature count. Leave affects scheduled time, worked time, accrual balances, pay, attendance reporting, and sometimes a retroactive payroll correction. Each separate handoff creates another place for dates or hours to disagree.

What should you test in an FMLA tracking software demonstration?

  • One continuous-leave case: Follow the request from intake through eligibility criteria, documents, approval, time entry, reporting, and return-to-work steps.
  • One intermittent-leave case: Use an employee with a variable or non-40-hour schedule and verify how partial absences affect the remaining entitlement.
  • Forms and case documents: Confirm which DOL forms can be populated, where certifications are stored, and who can see sensitive case information.
  • Timesheet and schedule changes: Test a leave entry, a corrected timecard, and a retroactive payroll scenario instead of relying on a slide presentation.
  • Ownership and escalation: Write down what the system automates, what HR must decide, and when the case should be escalated for qualified review.

Where does FMLA software stop and HR judgment begin?

Software can apply configured criteria, route work, preserve records, and calculate from the data it receives. It cannot decide whether a disputed certification is sufficient, resolve an ADA accommodation issue, determine which state leave law controls a complicated case, or correct a policy that was configured incorrectly.

The DOL's current FMLA overview states that eligible employees of covered employers may receive job-protected leave for qualifying reasons, with continuation of group health benefits under the same conditions.
